It looks like you are getting glare from glass or something. Get as close to the glass as you can and the lens as perpendicular as possible. A dark cloth and duct tape to put it up with would get you two things: (1) ability to block glare from lights behind you and (2) hide you from the birds so they settle down.
I've actually put the camera on a tripod and draped a large towel over it and my head/torso for camoflage, which let me stand outdoors and get closer without scaring them away. But I don't do that much because it's really tiring standing there, motionless :)
For the most part, a flash doesn't seem to bother birds much and it's a great help - you get better contrast and a faster shutter.

I have been arrested on Domestic Violence call by my wife ( of cource false allegations) about month back. Police investigation did not find any evidences and never sent file to DA for filing hence DA never filed charges.
Now USCIS requesting following
1) Please submit an arrest record and final court dispositions for each of your arrests. Court dispositions must be in the original and bear the stamp and/r seal of the appropriate court or clerk. If a court disposition or police record is not available, you must provide official or certified evidence from the appropriate law enforcement agency or court confirming the record in unavailable. Please note, these documents must either be the original or certified copy.
How to get court deposition or evidence that no charge are filed against this arrest?
I have filed petition for expunging arrest record but that will take a while to conclude.
Please advice what proof I can send to USCIS that this arrest did not even result in charges in court.

Just got 3 transfer notices from CSC saying applcations transfered to NSC. Applcations reached July23rd at NSC. 140 approved from TSC.
Anybody in similar situation....

Company "A" had filed my H1B transfer after I accept their offer. I signed the offer letter
In offer letter no where it is mentioned that if I leave company , i have to pay H1B transfer expenses.
Also It is clearly written without any reason , time either way can terminate job. This is below from offer letter..
"I have read and accept this employment offer. I understand my services under this agreement will begin with the successful transfer of my H1B. I understand my employment is terminable at will, i.e., and either company or I may terminate the employment relationship at any time, with or without cause."
Now , I have a better offer ,I am not joining that company .
They are asking me for H1B transfer expenses.
Company is asking "You signed and agreed to become an employee, however you never even started working here to begin an employee/employer relationship also you keep delying your joing time..It is clear that the delays were a stall tactic and completely dishonest, which any court will agree with."
If I am not paying it, they are going to take legal action ..
Please let me know your thought or any lawyer can help me in case company files legal action and what will be charges

You will get a 3 year H1 with new company if you have an approved labor and approved I 140 with any company. Any company really means any company. If you have worked or not, have an H1 or not, etc. etc - nothing matters.
To get a 3 year H1, you need an approved labor and 140 from SOME employer, whether its your past employer, your current employer or a future employer.

1) Do we need to send any photographs for my AP?
2) Any proof of Identification (passport first page) or Drivers License
3) Any H1 approval notices? (I am still on H1B)
4) Also I filed my AP which is expiring in Dec-08 i.e. 150 days before its expiry and curious to know if anyone�s application got rejected or approved. (I guess 120 days is the limit)

Gurus Need Help.
We filed for I-485 on july 3rd..and got receipt numbers after calling USCIS for 3 of us.Yesterday we got receipt notices for me and my wife..but for my son we haven't received the notice when i checked the status online..it says case is rejected and here is the text message from the online..,
"On October 10, 2007, we determined that this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was not properly filed, rejected it, and mailed it back to you with all supporting materials along with a notice describing the reasons the case was rejected. The notice will also describe what will need to be done to properly submit the case"
Is any one with the similar situation? Please help what could be the reason??
and how long it will take to receive the rejected notice?

I had recently changed jobs and my new employers attorney were going to file AC21. But my company was acquired by another large corporation and the attorneys have changed. The merger company's attorneys are Pappas and Lenzo. Does anyone have experience with this firm , in terms of h1 filing, I-140/I-485 related cases and other GC stuff like AC21, etc.
Any input would be greatly appreciated.

Ajju, Mine & wife's applications for 485/EAD/AP reached Nebraska on 07/25/07 and I have receipt dates of 08/27/07. I'm yet to receive it from my lawyer. Found out the LIN #'s from the back of my encashed check. No finger print notice yet. I do not think every one who filed between 07/17/07 to 08/17/07 will have a receipt date of 07/17/07

8/27 should be your Notice Date... per online status it will say received on 8/27.. but its ND... Once you get physical receipts... the RD has to be 7/24 in all normal scenarios... But for July fiasco filers.. I think it could be just 7/17... Update once you get the physical receipts.. I may be wrong... just noticed this in one case only yet...

I have filed I-485 in Aug2007 and am in retrogression. I am currently working for my sponsoring employer on H1 but also have EAD and AP. I have to go to India to address parents health issues and may have to stay there for possibly 6-9 months. I plan on re-entering using AP.
1) Will my GC application stay active if I am gone for such a long time?
2) My fingerprinting was done long ago - do I need to be in US when my case is adjudicated and GC approval is sent in the mail?

My parents got their second Re-entry Permit approved (applied through Application I-131) in first week of Jan 2008. This rentry permit is valid for 2 years (i.e. till Jan 2010). They had applied for the second Re-entry Permit on 16th Feb 2007. And after applying it they left 19th Feb 2007.
They are planning to return to US in Jan 2010 before the Re-entry Permit expiration. I read on this and other forums that with Re-entry Permit a US resident can live outside for more than 1 year and less than 2 years.
In my parent's case, when they will return back to US in Jan 2010, they will already have spend 3 years outside US.
I was concerned that the 2 year stay limit will be counted from the day my parents left US or the day when the Re-entry Permit got approved?
