Its good to hear that GC holders are also willing to help us. Have them register on our site and request them to make phone calls. If you know US citizens tell them too. Tell them to mention that they are US citizens when they call lawmakers.

My employment based I-485 application has been pending since Aug'2004. My labor priority date is May 2003. I came to know from immigration officer from local office few weeks ago that name check process was cleared very recently. But, USCIS has responded to a recent service request as follows:
The processing of your case has been delayed. We are currently awaiting the results of required security checks on this case. These background checks are required of all who apply for the immigration benefit your are seeking. We will make every effort to make a decision on this case as soon as security checks are complete. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact us by calling our customer service number provided down below.
If name check is cleared what else is pending? Is information provided by the immigration officer at local USCIS is wrong regarding the security checks.
Could you please throw some light on these background checks. What are my options. How many more years do i have to wait? Your valuable information in this regard is greatly appreciated.

i am in same situation. i applied for employment base in Dec 2004 and family based in May 2006 through my sister. Rightnow i'm on EAD and my sister based F4 category have priority Dec 2001.
You can apply in both category. when i was filing 485 (EB3), there is question if any other 485 petition is pending? The answer is "NO" even i have applied (I-130) under Family based GC. My lawyer said filing I-130 (for family based GC) is not consider as another petition (485) for GC. So it is ok to apply in both.

I enter US four times this year by using AP, same airport, but different experience. 1st, 2nd and 3rd entry was sent to secondary check. But the 4th entry, the CBP said it's unnecessary for secondary check and fill new I-94 because previous officers are new guys, don't know the rule. I thought 1st entry is definitely need go secondary check.

My PD is not in this range. Mine is July-2001 kind of >= 2002.
I have seen an ALIA observation on EB2 Retro. Trying to figureout how soon these Visa #'s for EB2 catagory is vanished. I will have an analysis from this will post here.

Hi ALL,
I'm a newbie in the forum and i need help from all regarding the below issue i have.
I'm a F1 student and presently working as a Software Engineer.I have been on OPT from January 2010 and i have recently got an extension for another 17 months which is a total of 29 months of OPT from January 2010 till June 2012, My main question was when do i need to apply for H1 and are there different types of H1?
What are the dates for applying for H1 and the start date for H1?
I will be done with my OPT by June 2012, so when should i start my H1 filling and is there any way that i can extend my status?
what are the ways of applying for H1?

I am working on an H1B visa for one of the world's largest retailers. I am in my 5th year of my H1 visa status and it expires in 2011. If an LCA is filed before July 2010 which is a 365 day point I will be allowed to extend my H1 for another 3 years while my Green Card is in process.
The situation is that the advertisement has been done in NJ and they received 100 applications which makes it difficult to support their statement of me being the most capable one beyond all US citizens. So they have decided now to advertise once again in a remote location in NJ and another in VA. Is it ok to file the LCA for a single employee from 2 different locations. Are there any risks involved? Do I need to move to VA in case it is approved before the whole process is done? or can it be avoided till I get my Green Card as I'm working for the same employer in a different state?
Any info and advice is much appreciated.

Our lawyer had posted our application on July 2nd and we had our fingerprinting scheduled for 21st august which was completed.
I checked my status on the USCIS site for the very first time today. And it says. "On July 30, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice describing how we will process your case" . Can anyone kindly explain me what this means ( how July 30th and what mail are they talking about ?we never received any! ) ...

It's really impossible to answer this without knowing the exact employment relationship that is planned and what the denial said in detail. Presumably your employer has a lawyer who can advise on whether an appeal might be successful. It is very likely that the denial was based on there not being the correct "employer-employee" relationship. CIS issued a new memo on this last month, and there are many threads in this forum on the topic.
